Interview with Steve Bliss, Wildomar Probate Attorney

Reporter: Brenda Lee

Today, we’re speaking with Steve Bliss of Wildomar Probate Law. Mr. Bliss is a seasoned probate attorney who helps families navigate the often-complex process of settling estates. We wanted to get his insights on one of the key steps in estate planning.

Steve:

It’s great to be here, Brenda. I’m always happy to shed some light on the importance of proper estate planning.

Brenda: Steve, could you walk us through the process of marshaling estate assets?

Certainly. Marshaling estate assets is a crucial step that typically occurs after the court appoints an executor or administrator. Essentially, it involves a thorough inventory and appraisal of all the deceased person’s assets.

This can include everything from bank accounts and real estate to personal property like vehicles, jewelry, and even digital assets. The goal is to create a comprehensive picture of the estate’s financial worth. Consequently, this detailed accounting is essential for accurately calculating debts, taxes, and ultimately, the distribution of assets among heirs.

We use specific forms mandated by the California Probate Code, such as the Inventory and Appraisal (Forms DE-160/161), to meticulously document each asset. This level of detail ensures transparency and accountability throughout the probate process.

Brenda: Have you ever encountered any challenges while marshaling estate assets?

There have been instances where locating all the assets proves tricky, especially if the deceased didn’t maintain organized records. I recall a case where it took considerable detective work to track down a forgotten retirement account. The client was unaware of its existence, and it turned out to be a significant asset for the estate.

Moreover, dealing with digital assets can present unique challenges. Accessing online accounts, social media profiles, and cryptocurrency holdings often requires navigating complex legal procedures and obtaining authorization from service providers.

Brenda: What advice would you give to individuals planning their estates?

  • Maintain clear and organized records of all your assets.
  • Discuss your wishes with loved ones, including the location of important documents.
  • Consider consulting with an experienced estate planning attorney who can guide you through the process and help ensure your assets are distributed according to your intentions.

Steve:

It’s never too early to start planning for the future. A well-structured estate plan not only protects your loved ones but also minimizes potential conflict and legal complications down the road. Remember, a little foresight can go a long way in ensuring peace of mind for both you and your family.

Brenda: Thank you for sharing your expertise with us today, Steve.

It was my pleasure. Feel free to reach out to Wildomar Probate Law if you have any questions or need assistance with estate planning or probate matters. We’re here to help navigate this often-complex journey.
