What inspired you to focus on Elder Protection Law?

It’s great to be here. You know, I’ve always been drawn to working with vulnerable populations. Can you walk us through the typical steps involved in an elder protection case?

Certainly. The process usually begins with an initial consultation where I get to know the client, their situation, and their goals. Then, we carefully assess the legal issues at hand, which could range from financial exploitation to physical abuse. From there, we develop a tailored strategy that may involve protective orders, guardianship petitions, or civil litigation.

  • Case Assessment: Identifying the legal issues, gathering evidence, and evaluating the risks involved
  • Protective Actions: Taking immediate steps to safeguard the elder, such as restraining orders or transferring assets
  • Legal Proceedings: Pursuing justice through civil lawsuits or criminal charges if necessary
  • Long-Term Planning: Helping elders establish safeguards for the future, like estate planning and advance directives

Let’s delve into “Protective Actions.” Can you elaborate on what that entails?

“Protective actions” is where we shift from assessment to intervention. This stage often involves taking swift action to minimize harm and protect the elder’s well-being. Sometimes, this means filing for a restraining order against an abuser.

Other times, it might involve petitioning the court for guardianship or conservatorship if the individual lacks capacity to make their own decisions. We also work closely with Adult Protective Services (APS) and law enforcement to ensure a coordinated response.

I remember one case where an elderly woman was being financially exploited by her caregiver. We were able to freeze her bank accounts, prevent further theft, and eventually recover some of the stolen funds. Seeing the relief on her face when we secured her financial safety was incredibly rewarding.

Let’s not forget the emotional aspect for both the elder and their family members. How do you navigate those sensitive situations?

You’re right, elder protection cases can be emotionally charged. It’s crucial to approach each situation with empathy and understanding. I always make sure to communicate clearly and compassionately with my clients, explaining the legal process in a way that they can grasp. I also connect them with resources like support groups and counseling services if needed.
