Ted, Can You Walk Us Through “Establishing a Conservatorship”?

Absolutely. So, first things first, someone – typically a concerned family member or friend – needs to file a petition with the court. This document lays out the reasons why they believe a conservatorship is necessary. The court then sends out notices to all interested parties, including the individual who may need a conservator (we call them the “proposed conservatee”).

There’s also an investigation by a court-appointed investigator or social worker who interviews everyone involved and assesses the situation. And importantly, a medical or psychological evaluation is often required to confirm that the proposed conservatee truly lacks the capacity to make decisions for themselves. Finally, all of this information is presented to a judge at a hearing, who then decides whether to grant the conservatorship.
